Regular Meeting

K. Metzler called the meeting to order at 7:32.

D. Schreiber motioned to seat T. Gutowski and R. Peloquin for G. Blessing and F. Dirrigl.

Fed Ex Ground Facility: TPA Design Group submitted the final monitoring report to the CTDEP and the Town of Willington in July 2007 which constituted the end of the 10 year Wildlife Habitat Management Plan for the subject facility.  Request the release of the escrow account.

K. Metzler commented that F. Dirrigl had been following this closely.  T. Gutowski asked for an electronic version of the 10 year plan.  The commission asked staff to notify F. Dirrigl and provide him with the information.

W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

Rylan Farr, of APEX Co., was present for Travel Centers of America and presented plans.  He said he is still waiting on the NPDES permit from DEP.  He said the draft permit is currently semi-annual but he believes it will increase to quarterly.  A discussion was held.  K. Metzler asked the condition of the basin in which Mr. Farr said was very good; full of cattails.  He explained the outlet of the pond and a discussion was held on sediment.  He said they installed an outlet T on the 18,000 gallon separator and explained the workings.

A discussion was held on the past spills and the amount of time it takes to get orders back from DEP.  Mr. Farr said they pulled the oil/water separator and put in a holding tank which has an audio and visual alarm system built in.  A discussion was held.  

Mr. Farr said he is waiting on the permit and cannot revise the BMP until then.

R. Peloquin said how will we know the tank is being pumped?  Mr. Farr said it will be on a schedule but right now they are pumping as needed.  R. Peloquin asked how many wells were drilled into the bedrock.  Mr. Farr said 4 or 5.  

A discussion was held on what might happen to the tank, in regards to the alarm, in a blizzard.

Mr. Farr said they are waiting on the NPDES permit and the site is still under a consent order.  He briefly explained the new plan and what it will include.  The commission thanked him for coming in.

Approval of Minutes

Steve Amedy was present to discuss an item in the minutes.

K. Metzler recused himself.

T. Gutowski motioned to approve the minutes of 11/24/2008.  R. Peloquin seconded the motion.

Mr. Amedy said there are two points he would like to bring up regarding the motion in the 11/24/2008 minutes.  On item #2, where it states each stage shall be completed and stabilized and approved by the clerk-of- works and the commission or its staff prior to going to the following stage.  Mr. Amedy expressed his concern on the wording and said the way he reads it, the work is to be 100% done.  He said they may be at 65% when they need to start the next stage.   They may sell 15 out of 20 units and then want to start the next phase.

T. Gutowski said this is what the commission brought forward and voted on.  A discussion was held on the wording.  Mr. Amedy said it is a play on words.  To him, completed and stabilized means all the houses have to be done.  He explained a current project they are working on and when 15 out of 20 units are done, they may need to start getting the next stage ready for example, put a road in. He’s not sure if they can do that.

G. Jones said, if there’s a problem, he can come back to modify conditions of the approval.  He said his take on G. Blessing’s motion is he was looking at drainage and erosion control.  He advised Mr. Amedy to come in and ask the commission, as a whole, for clarification.

Mr. Amedy commented that he likes to get 90 to 95% sold before he puts the final course of pavement down or the trucks will rip it up.  A discussion was held.

R. Peloquin commented that he felt the commission wanted to get the site stabilized before he went to the next stage and not left open.

Mr. Amedy bought up condition #5 and said he would like a minimum standard set for the Clerk of Works.  He said minimum credentials would give them and the commission some comfort level.  T. Gutowski said the concerns he has can be addressed when they hire a Clerk of Works.  R. Peloquin said they want to make sure he or she has all of the qualifications that they should.

All in favor of the minutes.  Motion carried.

Staff Report

A discussion was held on the salt at the town garage.  The commission asked if S. Yorgensen could provide more detail.

R. Peloquin motioned to adjourn at 8:44.  D. Schreiber seconded the motion.  All in favor.
